Article 1 Purpose
These terms and conditions govern the rights, obligations, responsibilities, and related procedures with users and members who use the official site “yatavent.com” (hereinafter referred to as “Yatavent Site”) operated by Yatav Co., Ltd. (hereinafter referred to as “Company”). The purpose is to stipulate and other necessary matters. When using the company's services or signing up as a member, the user confirms and agrees to these Terms of Use and related operating policies.
Article 2 Definition of Terms
1. The definitions of terms used in these Terms and Conditions are as follows.
‘Service’ refers to the ‘Yatav’ service provided by the company regardless of the type of wired or wireless terminal.
‘Member’ refers to a user who accesses the Company’s services and uses the services provided by the Company in accordance with these Terms and Conditions.
‘Content’ refers to all videos, images, text, etc. produced by the company, uploaded or provided by members.
2. Definitions of terms not specified in this Article shall be governed by relevant laws and general commercial practices.
Article 3 Effect and change of terms and conditions
1. These terms and conditions are effective for all users who wish to use this company’s services.
2. The company is not responsible for any damage caused by a member's failure to read the information in the terms and conditions in detail.
3. Depending on the needs of service operation, the Company may revise these Terms and Conditions to the extent that they do not violate relevant laws, such as the Act on Consumer Protection in Electronic Commerce, etc., and the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.
4. If the company revises the terms and conditions, the revision and application date will be specified and posted on the service screen or announced through other means from 7 days prior to the application date until the day before the application date. However, in the case of significant changes to the terms and conditions that may be disadvantageous to members, notice will be given from 30 days prior to the date of application until the date of application.
5. Upon the user's request, the Company will provide the user with a copy of these Terms and Conditions and will arrange for the user to print these Terms and Conditions within the service.
Article 4 Terms and Conditions
Matters not disclosed in these Terms and Conditions are related laws and regulations such as the Framework Act on Telecommunications, the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Act on Consumer Protection in Electronic Commerce, etc., and the detailed service usage guidelines set by the company. Article 5 Service Contents
The Company may provide the Yatav Service to members in accordance with these Terms and Conditions, and, if necessary, may entrust the service to a third party.
Article 6 Rights and Obligations of the Company
1. The Company does not engage in any acts prohibited by relevant laws or these Terms and Conditions or against public order and morals, and strives to provide continuous and stable services in accordance with the provisions of these Terms and Conditions.
However, in unavoidable cases, such as when there are difficulties in using the service due to natural disasters, emergencies, regular inspections, facility failures, or excessive use, the service may be temporarily suspended or discontinued.
2. The company establishes a security system to protect personal information so that members can safely use the service, and discloses and complies with the personal information processing policy.
3. The company must process opinions and complaints that are deemed legitimate by members in relation to the use of the service.
4. In order to improve and promote the service, the company may post or transmit content such as user reviews written within the service to other portal sites, etc. through partnerships and agreements.
Article 7 Prohibited Activities by Members
1. Members must not engage in any of the following acts. If they commit such acts, they may suspend use of part or all of the service or terminate the service use agreement at their discretion. In this case, the member is responsible for any damages incurred. I bear it. If necessary, the company may notify the relevant government or judicial agency of a member's prohibited conduct, and the member may be subject to sanctions, including legal action.
Entering false information when applying for or changing service use, or stealing and using other people's information illegally
Unauthorized alteration of information posted by the company
Transmitting or posting information other than that specified by the company
Acts that infringe on the copyrights and other rights of the company and other third parties.
Any act that damages the reputation of the company or other third parties or interferes with their business.
Swearing, obscene language, obscenity, or behavior that does not conform to the regulations
Posting or transmitting material that contains software viruses or any other computer code, files, or programs designed to disrupt or destroy the normal operation of computer software, hardware, or telecommunications equipment.
Any action that may interfere with the stable operation of the Yatav service or cause a failure of the Yatav service
Using the service for commercial purposes without the company’s consent
Other acts prohibited by the operating policy when the company determines that it is necessary to restrict the use of the service.
2. Members are responsible for compensating for damages suffered by the company or other members due to reasons attributable to them.
Article 8 Restrictions on service use
1. If the Company has reasonable grounds to suspect that a user violates the relevant laws, these Terms and Conditions, or the Operational Policy, or infringes upon the rights of others, or engages in such illegal or unfair acts, the Company shall revise the Terms and Conditions and the Operational Policy. The use of the Yatav Service may be restricted as determined (hereinafter, various restrictions on the use of the Yatav Service stipulated in this Article are referred to as “use restrictions, etc.”).
2. If any of the following reasons arise for a member, the company may take measures such as restricting or suspending the member's use of the Yatav service, or terminating the service agreement. Specific standards and procedures are determined in the operating policy.
If you defame another member or a third party by slandering them or stating false facts.
When disseminating information, sentences, or shapes that violate public order and morals, such as pornography or profanity.
When engaging in unauthorized commercial or business activities
Content that infringes upon the intellectual property rights or other rights of other members or third parties.
Any act that violates other relevant laws, these terms and conditions, and operating policies.
Other serious reasons that may discontinue a member's use of the service
3. If the Company imposes restrictions on the use of the Yatav Service pursuant to this Article, the Company will notify the Member by email or other means, unless otherwise specified in these Terms and Conditions. However, if there are unavoidable reasons, use restrictions may be imposed first and then notified later.
Article 9 Protection of members’ personal information
1. The company strives to protect members’ personal information in accordance with relevant laws and regulations. All information provided by members to the company is subject to the company’s personal information processing policy.
2. The company must maintain strict security for members' personal information and use it only for service operation and improvement, and will not provide it to other organizations or individuals for any other purpose. However, this does not apply in the following cases:
When there is a request from a relevant agency for investigative purposes in accordance with relevant laws and regulations
When there is a request from the Information and Communication Ethics Committee
If there is a request in accordance with the procedures prescribed by other relevant laws and regulations
3. The company may entrust a member's personal information to a third party to manage the member's personal information.
4. The company is not responsible for any personal information exposed due to reasons attributable to members.
Article 10 Intellectual property rights, etc.
1. Copyright and other intellectual property rights for the services, content, and all other works provided by the company belong to the company. Members must not use the information obtained by using the services provided by the company for commercial purposes or allow third parties to use the information obtained by using the services provided by the company by copying, reprocessing, transmitting, publishing, distributing, broadcasting, or other methods without prior permission of the company.
2. If a member's posting contains content that violates relevant laws such as the Information and Communications Network Act and the Copyright Act, the rights holder may request suspension or deletion of the posting in accordance with the procedures established by the relevant laws, and the company will take action in accordance with the relevant laws. It must be done. In addition, even if there is no request from the rights holder, the company may take temporary measures against the posting in question in accordance with relevant laws if there is reason to believe that it is a violation of rights or if it violates other company policies or related laws.
Article 11 Compensation for damages
1. If the company violates the relevant laws and regulations and causes damage to the member due to the company's intention or negligence, the member may file a claim for damages against the company.
2. If the member violates the provisions of these Terms and Conditions and causes damage to the company, the company may claim compensation from the member. In this case, the member cannot avoid liability if he or she cannot prove that there was no intent or negligence.
Article 12 Disclaimer
1. The company is exempt from liability in any of the following cases and is not responsible for compensating for any resulting damage.
If the service cannot be provided due to natural disaster, war, or other force majeure
If damage occurs because the telecommunication service provider suspends or fails to provide telecommunication services properly
If damage occurs due to unavoidable reasons such as repair, replacement, regular inspection, or construction of service equipment
If there is intentional service interruption by a third party who has entered into a service partnership agreement with the company to provide the service.
In case of disruption or damage to the use of the service due to the member's fault
2. The company is not responsible for any damages related to the use of services provided free of charge to members.
Article 13 Dispute Mediation and Others
1. The company and members must make sincere efforts to amicably resolve any disputes that arise in connection with the service.
2. Services provided by the company must be used only for lawful purposes, and use in a form that violates the laws of the Republic of Korea is prohibited. The company is not responsible if any damage occurs due to a member's use of a prohibited form.
3. If a member requests relief for damage related to an e-commerce dispute that arises between the company and the member, the dispute may be subject to mediation by a dispute resolution agency requested by the Fair Trade Commission or the city or provincial governor.
4. If a lawsuit is filed regarding a dispute arising from the use of the service, the court with jurisdiction over the location of the company's headquarters shall be the competent court.
